The Florida Department of Transportation has acquired all of the property for its I-95 at Atlantic Avenue interchange project in Delray Beach. Constitutionally required full compensation remains to be determined for some of our firm’s clients, with mediations scheduled in the upcoming months. This project is in a developed urban area, impacting commercial properties such as mixed retail and warehouse, convenience stores, and gas stations. The partial takings from our clients’ properties on this project have created complex valuation issues involving impacts to access, site circulation, and parking, and the application of local code setback and buffer provisions to the remainder property.
